welcome to our website and services. these terms of service ("terms") constitute a legally binding agreement between you and our company regarding your use of our website, purchase of online goods, participation in online or in-person classes, and booking of floral services (collectively, the "service").
1. arbitration notice & dispute resolution
by accepting these terms, you agree that all disputes arising out of or relating to your use of the service or purchase of products/services will be resolved through binding, individual arbitration. you waive your right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration.
2. eligibility
you must be at least 18 years old to use the service, purchase goods, or register for classes and floral services. by using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.
3. accounts, memberships & subscriptions
to access certain features, such as booking classes, managing recurring memberships, or purchasing goods, you may be required to register for an account. you are responsible for maintaining the accuracy of your account information and the confidentiality of your password. you accept full responsibility for all activities that occur under your account.
recurring subscriptions & memberships: recurring class passes, memberships, or subscriptions automatically renew on their designated billing cycle date unless canceled at least 48 hours prior to the billing date through your account settings or written notification.
community code of conduct: we foster an inclusive, supportive environment. we reserve the right to cancel memberships or deny access to online or in-person classes to anyone violating community standards of respect and kindness.
4. e-commerce purchases, shipping & inspection
scope: we ship physical goods strictly within the continental united states. we do not ship to alaska, hawaii, u.s. territories, or international destinations.
pricing & availability: all product prices are subject to change without notice. orders are subject to product availability.
title & risk: risk of loss and title for physical items pass to you upon our delivery of the package to the shipping carrier.
non-perishable inspection window: for non-perishable hard goods, you must inspect items upon receipt. claims for damaged, defective, or missing items must be reported within 15 days of delivery.
5. yoga & pilates physical activity waiver & release
assumption of risk: participating in physical exercise, including yoga, pilates, mat, and apparatus training (whether streaming online or attending in person), carries inherent risks of bodily injury. by registering for or participating in any class, you knowingly and voluntarily assume all risks, both known and unknown, associated with your participation.
release of liability & medical authorization: to the fullest extent permitted by law, you expressly release, waive, and hold harmless our company, instructors, and staff from any claims, liability, or damages arising out of personal injury or negligence. you represent that you are in good physical health and have consulted a physician if necessary. in an emergency, you authorize our staff to secure medical treatment on your behalf.
cancellations & bookings: class schedules, instructor assignments, and class reservation/cancellation deadlines are subject to change. class bookings, class packs, and drop-in fees are non-refundable except where required by law.
6. floral services, perishables & live events
perishable goods & short inspection window: fresh flowers are natural, perishable products. variations in bloom size, shade, and stage of open bloom are normal. because flowers are perishable, any quality issues, delivery concerns, or missing items must be reported with photographic evidence within 24 hours of receipt or event completion.
substitutions: we reserve the right to substitute flower varieties or containers of equal or greater value if specified blooms are unavailable due to seasonal or supply conditions.
event installations & venue logistics: for custom floral setups, mobile bloom bars, or live events, client must ensure clear venue access and suitable climate conditions (protection from extreme heat, direct sunlight, freezing temperatures, or severe weather). we are not liable for delayed setups caused by venue restriction or damage to perishable blooms resulting from unfavorable weather or unsuitable outdoor environments.
event cancellations & retainers: cancellations or modifications for custom floral contracts or live event services must follow the timeline in your specific event service agreement. retainers and booking deposits are non-refundable.
7. user content & intellectual property
user submissions: if you submit reviews, photos, or tag us on social media, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, and reproduce your content for promotional purposes across our channels.
proprietary rights: all website content, logos, graphics, instructional videos, and materials remain our exclusive property or the property of our licensors. unapproved reproduction or distribution is strictly prohibited.
8. prohibited conduct
you agree not to use the service for any unlawful purpose, scrape or mine data from the site, reverse engineer any site functionality, disrupt class environments (online or in-person), or interfere with the operation of the website.
9. disclaimers and limitation of liability
as-is provision: to the maximum extent permitted by law, the service, products, classes, and floral offerings are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
cap on liability: to the maximum extent permitted by applicable law, our total cumulative liability for any claim arising out of or relating to the service is limited to the greater of $100 or the total amount you paid us in the single month preceding the event giving rise to the claim. we are not liable for any indirect, incidental, consequential, or punitive damages.
10. modifications & termination
we reserve the right to update these terms or modify/discontinue any aspect of our service at any time. your continued use of the website following updated terms indicates acceptance of the revised conditions. we reserve the right to terminate your access or account for any violation of these terms.
